I. Informacje Ogólne
Regulamin określa warunki , na których można dokonać rezerwacji i wynajmu apartamentów. Prezentowany regulamin stanowi integralną cześć umowy wynajmu. Każda osoba , która dokonuje rezerwacji, jednocześnie akceptuje warunki niniejszego regulaminu.
Katarzyna Kułach – podmiot będący stroną umowy najmu Apartamentu świadczący usługę krótkotrwałego wynajmu lokali mieszkalnych Klientom zainteresowanym najmem apartamentu.
Klient – osoba prawna lub osoba fizyczna posiadająca zdolność do czynności prawnych w rozumieniu zapisów KC, będąca stroną umowy o czasowe korzystanie z lokalu mieszkalnego (umowy najmu Apartamentu).
Apartament – lokal mieszkalny, który Klient wynajmuje na pobyt czasowy w celach wypoczynkowych lub turystycznych.

II. Rezerwacje
1. Klient wypełnia formularz rezerwacji na stronie www lub przesyła na adres e-mail kulach.handel@gmail.com zapytanie
dotyczące wybranego przez niego apartamentu celem dokonania rezerwacji. Klient może dokonać rezerwacji telefonicznie.
2.Rusińska Osada przesyła na adres e-mail Klienta, wstępne potwierdzenie rezerwacji. Celem potwierdzenia zgłoszenia rezerwacji wymagana jest od Klienta przedpłata w wyznaczonym terminie w wysokości 30% na poczet rezerwowanego pobytu lub całości kwoty wynajmu o czym decyduje Rusińska Osada. Przedpłata jest wymagana każdorazowo, o obowiązku dokonania przedpłaty decyduje Rusińska Osada informując klienta w wysyłanym mailowo potwierdzeniu.
3. Rezerwacja jest skuteczna z chwilą uznania rachunku bankowego Rusińska Osada opłatą rezerwacyjną.
4. Ostateczne potwierdzenie rezerwacji stanowi umowę najmu, która wchodzi w życie pod warunkiem zapłaty ceny za usługę w terminach i na zasadach wskazanych w niniejszym regulaminie.
5. Oferta oraz podane ceny mają jedynie charakter informacyjny i nie stanowią oferty handlowej w rozumieniu Art. 66 par.1 Kodeksu
Cywilnego. Cena musi zostać potwierdzona przez obiekt Rusińska Osada telefonicznie bądź e-mailem.

III. Anulowanie rezerwacji
1. Klient może anulować rezerwację wyłącznie pisemnie –mailem. W przypadku anulowania rezerwacji na minimum 30 dni przed planowanym przyjazdem zaliczka zostanie zwrócona po potrąceniu kosztów obsługi w wysokości 10% wartości zaliczki. W przypadku anulowania rezerwacji w terminie krótszym niż 30 dni przed przyjazdem zaliczka w wysokości 30% kwoty pobytu nie podlega zwrotowi. W przypadku nie dojazdu i anulacji rezerwacji w dniu przyjazdu pobierana jest płatność w wysokości 100% za pobyt. W przypadku zgody Rusińska Osada na zameldowanie i wymeldowanie w godzinach innych niż wyznaczone, pobierana jest dodatkowa opłata oraz wymagana jest zapłata całości za pobyt z góry.
2. Zmiana rezerwacji jest możliwa wyłącznie za zgodą obiektu Rusińska Osada jeżeli ta posiada dostępny ten sam lub inny Apartament który może zaproponować klientowi. W takim przypadku zmiana nie podlega dodatkowej opłacie. Zmiana rezerwacji nie jest możliwa jeżeli dotyczy ścisłego sezonu (święta, wakacje, ferie, sylwester, długie weekendy), Gdy zmiana rezerwacji nie jest możliwa, a Klient odstąpił od umowy, anulował rezerwację, bądź nie wykonał umowy (brak przyjazdu), Rusińska Osada uprawniona jest do potrącenia wpłaconej 30% kwoty pobytu (opłaty rezerwacyjnej), lub całości za pobyt.
3. W przypadku przyjazdu większej ilości osób niż zadeklarowanej podczas rezerwacji potwierdzonej przez obiekt Rusińska Osada. Rusińska Osada zastrzega sobie prawo do natychmiastowego zerwania umowy , co wiąże się z opuszczeniem apartamentu, lub jego nie udostępnieniem Klientowi
4. W przypadku wcześniejszego opuszczenia apartamentu lub późniejszego przybycia Rusińska Osada nie zwraca pieniędzy za niewykorzystany pobyt.
5. Rusińska Osada może anulować lub zmienić rezerwację, wyłącznie w przypadku wystąpienia zdarzeń niezależnych od obiektu Rusińska Osada w wyjątkowych sytuacjach (awarii w Apartamencie lub innego zdarzenia losowego) Zmiana rezerwacji polega na udostępnieniu Apartamentu zamiennego o parametrach i powierzchni podobnej do zarezerwowanego Apartamentu, w tej samej miejscowości. W wypadku braku zgody Klienta na substytucyjny Apartament umowa ulega rozwiązaniu, a Rusińska Osada ma obowiązek zwrotu Klientowi wpłaconej przez Niego zaliczki.

IV Warunki płatności:
1. Celem potwierdzenia rezerwacji do 2 dni od jej złożenia – 30% wartości pobytu, lub całości za pobyt.
2. Pozostała część, przelewem przed przyjazdem (decyduje data uznania rachunku Rusińska Osada), lub gotówką w dniu przyjazdu.
3. Całość musi być wpłacona najpóźniej w dniu rozpoczęcia najmu apartamentu.
4. Obiekt Rusińska Osada może pobrać dodatkowe opłaty za klimatyzację, wymianę ręczników, zmianę pościeli lub sprzątanie w czasie pobytu. Obowiązuje całkowity zakaz pobytu zwierząt na terenie i wewnątrz obiektu Rusińska Osada.

V. Warunki pobytu
1. Pobyt w apartamencie możliwy jest od godziny 16.00 w dniu przyjazdu do godziny 10.00 w dniu wyjazdu. Ewentualny wcześniejszy przyjazd lub późniejszy wyjazd możliwy jest po uzgodnieniu z osobą zarządzającą obiektem Rusińska Osada, w miarę dostępności Apartamentu. Przyjęcie gości odbywa się od godz. 15 do godz. 20, wymagany jest wcześniej telefoniczny kontakt w celu podania dokładnej godziny przyjazdu.
2. Na zabezpieczenie ew. szkód wyrządzonych przez klienta w apartamencie oraz częściach wspólnych jest pobierana kaucja w wysokości 1000 zł, w dniu przyjazdu do apartamentu. Kaucja zwracana jest do 48 godzin od wyjazdu, przelewem na konto. Klient jest zobowiązany do poinformowania obiektu Rusińska Osada o wyrządzonych szkodach w apartamencie. Jeżeli straty przewyższają wysokość kaucji klient jest zobowiązany do niezwłocznego pokrycia różnicy. Wysokość odszkodowania ustala Rusińska Osada według własnej kalkulacji.
3. Za bezpieczeństwo i szkody wyrządzone przez dzieci odpowiadają rodzice i prawni opiekunowie.
4. Zabronione jest nieprzestrzeganie ciszy nocnej w godzinach od 22.00 do 6.00 rano, palenie papierosów w Apartamencie oraz częściach Wspólnych, łamanie zasad P.Poż , BHP, niszczenie Apartamentu lub wynoszenie z apartamentu jego jakiejkolwiek części. Klient ma obowiązek zabezpieczyć apartament podczas swojej nieobecności poprzez zamknięcie okien i drzwi, wyłączenie urządzeń mogących stanowić zagrożenie P.Poż.
5. W przypadku naruszenia zasad określonych w niniejszym paragrafie Rusińska Osada jest uprawniona do potrącenia z kaucji kosztów doprowadzenia Apartamentu do stanu poprzedniego. W przypadku gdy wartość w/w roszczeń przekracza wartość kaucji, Klient obowiązany jest pokryć tę różnicę niezwłocznie.
6. W przypadku rażącego naruszenia zasad określonych w niniejszym paragrafie, Rusińska Osada jest uprawnione do odstąpienia od umowy ze skutkiem natychmiastowym i usunięcia Klienta wraz z osobami mu towarzyszącymi z apartamentu w asyście Policji.
7. Za rzeczy pozostawione na terenie obiektu nie ponosimy odpowiedzialności.

Informacje podawane w przypadku zbierania danych od osoby, której dane dotyczą – sporządzone na podstawie Art. 13 RODO
Informuję, że:
1) Administratorem Pani/Pana danych osobowych jest Rusińska Osada Katarzyna Kułach z siedzibą w Bukowinie Tatrzańskiej, Wierch Rusiński 36 dane kontaktowe 600979250,516082901, zwany dalej Administratorem; Administrator prowadzi operacje przetwarzania Pani/Pana danych osobowych.
2) Pani/Pana dane osobowe przetwarzane będą w celu realizacji umowy, dostęp do danych będą miały osoby pracujące i współpracujące z Administratorem danych w zakresie realizacji na Państwa rzecz usług, w tym realizujących usługi wsparcia technicznego oraz podmioty realizujące usługi prawno-finansowe.
3) podstawą przetwarzania Pani/Pana danych osobowych jest Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679 z 27 Kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych (ogólne rozporządzenie o ochronie danych). Art. 6 ust. 1:
– w celu wykonania i na podstawie zawartej z nami umowy (b) przetwarzanie jest niezbędne do wykonania umowy, której stroną jest osoba, której dane dotyczą,…)
– w celu zawarcia umowy w związku z zainteresowaniem się nasze ofertą (b) lub do podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy;)
– podanie danych jest niezbędne do zawarcia umowy, w przypadku niepodania danych niemożliwe jest zawarcie umowy,
– w celu księgowym na podstawie obowiązku prawnego ciążącego na administratorze (c) przetwarzanie jest niezbędne do wypełnienia obowiązku prawnego ciążącego na administratorze;)
4) posiada Pani/Pan prawo do:
• żądania od Administratora dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania danych osobowych,
• wniesienia sprzeciwu wobec takiego przetwarzania,
• przenoszenia danych,
• wniesienia skargi do organu nadzorczego,
• cofnięcia zgody na przetwarzanie danych osobowych.
5) Pani/Pana dane osobowe nie podlegają zautomatyzowanemu podejmowaniu decyzji, w tym profilowaniu,
6) Pani/Pana dane osobowe będą przetwarzane przed dokonaniem rezerwacji oraz w trakcie pobytu w celu realizacji umowy, jak również po pobycie, przechowywane przez okres 3 lat w sytuacji kiedy gość rozlicza się za pomocą karty kredytowej, przez okres 6 lat w sytuacji kiedy została wystawiona dla gościa faktura , dane gości płacących wyłącznie gotówką zostają usunięte w dniu wyjazdu (chyba że prawo podatkowe oraz cywilno-prawne stanowi inaczej) zgodnie z Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r o ochronie danych
osobowych.

I. General Information
The regulations define the conditions under which you can book and rent apartments. The presented regulations are integral part of the rental agreement. Each person who makes a reservation accepts the terms of these regulations at the same time.
Katarzyna Kułach – an entity that is a party to the Apartment rental agreement, which provides the service of short-term rental of residential premises Clients interested in renting an apartment.
Client – a legal person or a natural person with legal capacity within the meaning of the Civil Code, being a party to the agreement on temporary use of a flat (apartment rental agreement).
Apartment – a flat which the Client rents for a temporary stay for leisure or tourist purposes.

II. Reservations
1. The customer fills in the booking form on the website or sends an inquiry to the e-mail address
kulach.handel@gmail.com concerning the apartment selected by him in order to make a reservation. The customer can make a reservation by phone.
2.Rusińska Osada sends an initial booking confirmation to the Customer’s e-mail address. Required to confirm the booking application there is an advance payment from the Customer within the prescribed period in the amount of 30% for the booked stay or the entire rental amount, about which Rusińska Osada decides. Prepayment is required each time, Rusińska Osada decides about the obligation to make the prepayment informing the client in the confirmation sent by e-mail.
3. The reservation is effective upon crediting the bank account Rusińska Osada with the reservation fee.
4. The final confirmation of the reservation is the lease agreement, which comes into force under the condition of paying the price for the service on the dates and on the terms set out in these regulations.
5. The offer and the prices quoted are for information purposes only and do not constitute an offer within the meaning of Art. 66 paragraph 1 of the Code Civil. The price must be confirmed by Rusińska Osada by phone or e-mail.

III. Cancelling the reservation
1. The customer can only cancel the reservation in writing – by e-mail. In the event of cancellation of the reservation at least 30 days before the planned arrival, the advance payment will be refunded after deducting the service costs in the amount of 10% of the advance payment. In the event of cancellation of the reservation less than 30 days before arrival, the advance payment of 30% of the amount of the stay is not refundable. In the event of failure to arrive and cancellation of the reservation on the day of arrival, a payment of 100% for the stay is charged. In case of consent Rusińska Osada for check-in and check-out at times other than those scheduled, an additional fee is charged and payment of the entire stay in advance is required.
2. Changing the reservation is possible only with the consent of Rusińska Osada if it has the same or a different Apartment available that can be offered to the client. In this case, the change is not subject to an additional fee. Changing the booking is not possible if it concerns the strict season (holidays, holidays, New Year’s Eve, long weekends), When the change of booking is not possible and the Customer has withdrawn from the contract, canceled the booking or has not performed the contract (no arrival), Rusińska Osada entitled is subject to a deduction of 30% of the amount of the stay (reservation fee) paid, or of the total amount for the stay.
3. In case of arrival of more people than declared during the reservation confirmed by Rusińska Osada. Rusińska Osada reserves the right to terminate the contract immediately, which involves leaving the apartment or not making it available to the customer.
4. In the event of early departure from the apartment or late arrival, Rusińska Osada will not refund the money for the unused stay.
5. Rusińska Osada may cancel or change the booking only in the event of events beyond the control of the Rusińska Osada facility in exceptional circumstances (breakdown in the Apartment or other random event). the town itself. If the Customer does not consent to a substitute Apartment, the contract is terminated, and Rusińska Osada is obliged to return the advance payment made by him to the Customer.

IV. Payment Terms:
1. To confirm the reservation up to 2 days from its submission – 30% of the value of the stay, or the entire stay.
2. The remaining part, by bank transfer before arrival (the date of crediting the invoice will be decisive Rusińska Osada), or in cash on arrival.
3. The whole amount must be paid on the day the apartment rental starts at the latest.
4. Rusińska Osada facility may charge additional fees for air conditioning, towel change, bed linen change or cleaning during the stay. Pets are strictly forbidden on the premises and inside the Rusińska Osada facility.
V. Conditions of stay
1. A stay in the apartment is possible from 16.00 on the day of arrival until 10.00 on the day of departure. Possible early arrival or later departure is possible after consultation with the person managing the Rusińska Osada facility, subject to the availability of the Apartment. Reception of guests takes place from 15 to 20, prior telephone contact is required to provide the exact time of arrival.
2. A deposit is charged to secure any damage caused by the client in the apartment and common areas 1000 PLN, on the day of arrival at the apartment. The deposit is refunded up to 48 hours after departure, by bank transfer. The customer is obliged to inform Rusińska Osada about any damage to the apartment. If the losses exceed the amount of the deposit, the customer is obliged to pay the difference immediately. The amount of compensation is determined by Rusińska Osada according to its own calculation.
3. Parents and legal guardians are responsible for the safety and damage caused by children.
4.It is forbidden to not respect the quiet hours between 10.00 p.m. and 6.00 a.m., smoke cigarettes in the Apartment and in the common parts, break the rules of fire protection, health and safety, destroy the apartment or take any part of it out of the apartment. The customer is obliged to secure the apartment during his absence by closing windows and doors, turning off devices that may pose a fire hazard.
5. In the event of violation of the rules set out in this paragraph, Rusińska Osada is entitled to deduct from the deposit the costs of bringing the Apartment to its previous state. If the value of the above-mentioned claims exceeds the value of the deposit, the Customer is obliged to pay the difference immediately.
6. In the event of a gross violation of the principles set out in this paragraph, Rusińska Osada is entitled to withdraw from the contract with immediate effect and remove the Customer and accompanying persons from the apartment, assisted by the Police.
7. We are not responsible for items left on the premises of the object.

VI. Information clause
Information provided in the case of collecting data from the data subject – prepared on the basis of Art. 13 of the
GDPR
I inform that:
1) The administrator of your personal data is Rusińska Osada Katarzyna Kułach with headquarters in Bukowina Tatrzańska, Wierch Rusińki 36 contact details 600 979 250. 516082901, hereinafter referred to as the Administrator; The administrator conducts the processing of your personal data.
2) Your personal data will be processed in order to perform the contract, access to the data will be granted to people working and cooperating with the Data Administrator in the provision of services for you, including those providing technical support services and entities providing legal and financial services.
3) the basis for the processing of your personal data is Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (general regulation on data protection ). Art. 6 sec. 1:
– in order to perform and on the basis of a contract concluded with us (b) processing is necessary for the
performance of a contract to which the data subject is a party, …)
– in order to conclude a contract in connection with the interest in our offer (b) or to take action at the request of the data subject, before concluding the contract;)
– providing data is necessary to conclude a contract, in the event of failure to provide data, it is impossible to conclude a contract,
– for accounting purposes based on the legal obligation of the administrator (c) processing is necessary to fulfill the legal obligation of the administrator;)
4) you have the right to:
• requests from the Administrator to access their personal data, rectify them, delete or limit the processing of personal data,
• object to such processing,
• data portability,
• lodging a complaint to the supervisory body,
• withdrawal of consent to the processing of personal data.
5) your personal data is not subject to automated decision making, including profiling,
6) Your personal data will be processed before making the reservation and during the stay in order to perform the contract, as well as after the stay, stored for a period of 3 years in a situation where the guest settles by credit card, for a period of 6 years in the case when the invoice issued to the guest, the data of guests paying only in cash are deleted on the day of departure (unless the tax law and civil law provide otherwise) in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of personal data.
